Harassment and Cyberbullying
The Board is addressing repeated hostile or intimidating electronic communications directed at homeowners, directors, or management.
Under ORS 166.065 (Harassment), repeated unwanted communications intended to harass, annoy, or alarm another person may constitute unlawful conduct. Online behavior is not exempt simply because it occurs by email or social media.
Examples of unacceptable conduct include:
Repeated unsolicited messages after being asked to stop
Personal attacks, accusations, or inflammatory language
Attempts to pressure or intimidate volunteers or owners
Escalating volume or tone of communications after boundaries are set
Disagreement with Board decisions does not justify abusive or harassing behavior.
Use of Owner Email Addresses
Owner email addresses are collected and maintained by the Association solely for Association business, including official notices, maintenance information, emergency communications, and Board-authorized correspondence.
They are not to be used for:
Personal grievances, campaigns, or disputes
Repeated mass emails sent without recipient consent
Communications after recipients have requested to be removed
Any use that causes harassment, confusion, or disruption
Continued mass emailing after recipients have expressed that the communication is unwelcome is not acceptable. The notion that recipients should simply “ignore or delete” unwanted emails does not relieve the sender of responsibility.
Under Oregon law, misuse of personal contact information may implicate privacy and consumer protection statutes, including the Oregon Consumer Privacy Act (ORS 646A.570–646A.589), which governs the collection, use, and misuse of personal data.Board Authority and Enforcement
Pursuant to the Association’s governing documents and applicable Oregon statutes (including ORS Chapter 94 or Chapter 100, as applicable), the Board has the authority to:
Establish and enforce communication rules
Restrict misuse of Association contact information
Take corrective action when conduct interferes with the Association’s operations or the rights of others
If inappropriate use of email addresses or harassing conduct continues, the Board may pursue formal enforcement measures, including restriction of communication channels and other remedies allowed by law.
Proper Channels for Communication
Owners with concerns are encouraged to communicate:
Directly with the Board or management
Through established, orderly channels
In a civil and respectful manner
Mass emailing other owners is not an appropriate substitute for these processes.
Closing
The Board’s goal is not to silence owners, but to ensure that communication within the community is lawful, respectful, and functional. Continued disregard for these standards will not be ignored.
